This article analyzes the specifics of applying the preventive measure "detention" in the main trial and its time limits. It examines the legal nature of this measure, its purposes, and its importance for ensuring effective judicial protection of the rights of participants in legal proceedings. Particular attention is paid to the criteria for determining the maximum periods of detention, procedural grounds, and the liability of officials. The article draws on the judicial practice of the Constitutional Court of the Republic of Kazakhstan in considering matters of applying preventive measures. It also addresses issues frequently arising during the consideration of complaints regarding the application of preventive measures and their time limits. Conclusions are drawn regarding the need for a uniform approach to the application of this measure in order to strengthen the principles of criminal procedure and ensure adequate protection of citizens' rights in criminal proceedings.
